Terms of Use

1. Acceptance of the Terms

These Terms of Service govern the use of wizma.eu, the WiZMA application and related services. By creating an account, signing in with Google or otherwise using WiZMA, you confirm that you have read and agree to these Terms and the WiZMA Privacy Policy. If you do not agree, do not create an account or use WiZMA.

2. What WiZMA is

WiZMA is an AI-supported early childhood development platform, primarily for children aged 3 to 8. Depending on the available version, WiZMA may include:

• personalised stories and story images;
• games, learning activities and challenges;
• emotional, breathing, calming and self-regulation activities;
• habit and daily routine creation and progress tracking;
• good deed and kindness challenges;
• “My Diary” activities;
• sleep support, white noise and calming sounds;
• learning approaches and recommendations or progress insights for parents.

3. Account holder and use by a child

A WiZMA account may be created only by an adult who is authorised to act on their own behalf and in the child’s interests. The account holder is responsible for the child’s use of WiZMA, selected content, information provided and appropriate supervision.

A child should not independently create an account, manage privacy settings or enter personal data without a parent present.

4. Google authentication and account security

WiZMA may offer sign-in with Google. The Google account is used to verify identity, create the account and provide secure authentication. WiZMA does not request access to Gmail, Google Drive, Google Calendar, contacts or other Google services.

You are responsible for the security of your Google and WiZMA accounts. If you suspect unauthorised use, protect the Google account immediately and contact us.

5. Information provided by the parent

For personalisation, a parent may provide the child’s first name or nickname, age, interests, learning approach, characters or goals. You confirm that you are authorised to provide this information and that it is as accurate as reasonably possible.

Do not enter the child’s surname, full date of birth, address, school or kindergarten name, photograph, document numbers, diagnoses, detailed health data or other unnecessary sensitive information.

6. AI-generated content

Some WiZMA content is generated or adapted by artificial intelligence. AI-generated content may be inaccurate, incomplete, repetitive or not aligned with every family’s values and individual needs. The account holder must assess whether content is suitable for the child’s age, development and situation before providing it to the child.

WiZMA applies reasonable safety measures but does not guarantee that every AI output will be entirely free of errors. Please report inappropriate content to info@wizma.eu.

7. Emotional wellbeing and professional support

WiZMA emotional, breathing, calming, habit, sleep, diary and parent insight features are intended for general education and everyday support. They are not a medical device, diagnosis, treatment, psychological therapy or individual professional opinion.

“My Diary” is not intended for emergency assistance or the storage of medical information. If you are concerned about a child’s health, development, safety or emotional state, contact an appropriate qualified professional. In an emergency, use local emergency services rather than WiZMA.

8. Acceptable use

When using WiZMA, you must not:

• enter unlawful or clearly child-inappropriate content;
• use information or materials without the necessary rights;
• attempt unauthorised access to systems or other accounts or bypass security restrictions;
• interfere with the service, distribute malicious software or overload the service through automated means;
• use WiZMA to harm a child or another person.

9. Saved content and progress

Where a feature allows it, the account may store stories and images, good deed challenges and progress, habits and daily routines, diary entries and completion information from certain activities. The account holder is responsible for managing entered and saved content.

Saved content may be edited or deleted where the relevant function is available, and all content linked to the account may be deleted by deleting the account. WiZMA may apply reasonable technical storage, file size or quantity limits.

10. Intellectual property

The WiZMA name, brand, design, software, interface, methodology structure, text, graphics and other platform materials are owned by SIA “WiZMA” or its licensors and are protected by applicable law.

To the extent permitted by law and third-party rights, WiZMA grants the account holder a non-exclusive, revocable right to use WiZMA-generated and saved content for personal, non-commercial family purposes.

11. User-provided content and feedback

You retain rights in information and materials that you lawfully enter into WiZMA and grant WiZMA a limited right to process them only as required to provide the service, maintain security and perform the features you request.

If you voluntarily provide ideas or feedback, we may use them to improve WiZMA without publishing your or the child’s identity and without using Google account data for advertising.

12. Availability and changes to the service

WiZMA may be in beta, pilot or active development. Features may be added, changed, limited or removed. We aim to provide stable operation but do not guarantee uninterrupted, error-free or always available service.

13. Free and paid features

A testing or beta version may be available free of charge. If subscriptions, purchases or paid features are introduced, the price, billing period, automatic renewal terms, cancellation process and applicable consumer rights will be clearly presented before purchase.

14. Account suspension, termination and deletion

You may stop using WiZMA and delete the account at any time. Instructions are available on the account deletion page. Account deletion removes data directly linked to the account, except information we are legally required to retain.

We may temporarily restrict or close an account if these Terms are materially breached, a security risk is created, the service is used unlawfully or action is required by law. Where circumstances permit, the user will be informed of the reason and any available way to challenge the restriction.

15. Limitation of liability

WiZMA is provided with reasonable care. To the extent permitted by applicable law, we are not liable for indirect losses resulting from misuse, inappropriate information entered by a user, interruptions to third-party services or use of AI-generated content without parental review.

Nothing in these Terms limits liability that cannot legally be limited or affects mandatory consumer rights.

16. Third-party services

WiZMA uses Google/Firebase, OpenAI and other technology services. Their operation may be affected by their technical limitations and terms. Links to third-party websites do not mean that WiZMA controls or guarantees their content.

17. Privacy

The processing of personal data is described in the WiZMA Privacy Policy. The Privacy Policy forms an integral part of these Terms in relation to personal data processing.

18. Changes to these Terms

We may update these Terms when WiZMA features, the business model, law or security requirements change. The current version and effective date will be available at wizma.eu/en/terms. Users will be informed of material changes in a reasonable manner.

19. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia. We will first try to resolve disputes through mutual discussions. Consumers may use applicable out-of-court dispute resolution procedures, contact the Consumer Rights Protection Centre of Latvia or bring a claim before a competent court.

Nothing in this section removes rights granted under mandatory EU law or the law of the consumer’s country of residence.
